Electronic signature disclosure

What this disclosure is

This page describes the electronic records and signature disclosure presented to participants before they sign a document through Waiver Studio. By proceeding to sign, a participant consents to using electronic records and electronic signatures in place of paper documents and handwritten signatures for that transaction.

Electronic signatures are recognized in many jurisdictions, including under the US ESIGN Act and UETA. Recognition and enforceability still depend on the document, the signing process, and applicable law.

Consenting to sign electronically

Before signing, each participant is shown a consent disclosure. Continuing past it and completing the signature constitutes agreement to conduct that transaction electronically. The record of each signing preserves the disclosure that was shown, alongside the document version, signature, and timestamp.

Consent applies to the transaction being signed. Signing a waiver never automatically enrolls a participant in marketing email or SMS—any marketing permission is separate and optional.

Your right to a paper copy

Participants may request a paper or PDF copy of anything they signed. After signing, participants receive an email confirmation, and the organization that published the waiver can retrieve and provide the complete signed record at any time. There is no fee from Waiver Studio for copies.

Withdrawing consent

A participant may decline to sign electronically before completing a signature—in that case, ask the organization you are signing with about paper alternatives. Withdrawing consent after a document has been signed does not undo the signed record; questions about a completed record should be directed to the organization that published the waiver.

Hardware and software requirements

Signing requires a device with a modern web browser and an internet connection (venues may also offer kiosk or offline signing on their own devices, which sync when reconnected). To receive confirmations, participants need a valid email address. If the requirements change in a way that creates a material risk a participant cannot access their records, the organization that published the waiver can always provide copies.

Keeping your contact details current

Confirmations are sent to the email address provided at signing. Participants should give an address they can access; corrections or updates after signing can be handled by the organization that published the waiver.
